At the end of this month the biggest trial for eviction in the whole history of Spanish democracy will be taking place, for a pacific eviction that took place in Terrasea in 1999. From the 32 accused, 26 are facing a 5 year 4 months setence after a procedure with lots of irregularities. This petition was the highest ever asked against people involved in the occupation of abandoned houses. Among the accused there are many universituy students (History, Psychology) a teacher of Universidad Autónoma de Barcelona and an archeologist. Five of the people accused today have children under five.
A major point in this trial, apart from the justification of preemptive evictions (that is, previous to the judge sentence,like in this case), is the property of the building. After the death of the owner more than 40 years ago this building wasn´t registered in the Will nor in the payments of taxes for the inheritance. The same happened in the next inheritance. To sum up, the "supposed" owner did not asume the payment of taxes and did not declare to the authorities any property of the building for decades. This fact caused a desestimation against the occupying inhabitants in a first judgement at the beginning of 1999. It was considered no property had been justified. After a reclaiming to that sentence, the Audiencia Provincial forced to admit a new trial in the issue which led to the preemptive evition. Today, the place where the biuiling was and after it was demolished is empty and full of rubbish.
